There is an English saying that the best throw with dice is to throw them away. But gambling is too tempting for people to actually throw away their dice. The negative consequences of gambling make it necessary for legislators to keep an eye on it. As part of the regulation of (commercial) gambling, the authorities have a range of measures at their disposal to enforce the law. One option is the confiscation of unlawful gaming facilities, which can now also be carried out by the trade authority in accordance with Section 148c GewO since the beginning of 2023. With this instrument, the legislator aims, among other things, to ensure that non-compliant games and gaming devices with winning opportunities are finally taken out of circulation.
