"The American Privacy Rights Act grants Americans basic, enforceable privacy rights, puts people in control of their own data, and eliminates the patchwork of state laws," reads a press release from the United States Committee on Energy and Commerce in April 2024, announcing what is considered a historic new draft for a comprehensive US federal privacy law (APRA). What makes it special is that such a comprehensive law would be the first of its kind among many state and sectoral data protection laws, although by no means the first attempt to establish such a law. Lisa Bolinth LL.B.'s article "The draft American Privacy Rights Act" shows how this draft is to be classified in the landscape of US data protection law and how it compares to the EU General Data Protection Regulation (GDPR). Overall, it is clear that APRA is based on a high level of data protection. However, a successful implementation of the APRA in the context of the US legislative process is anything but certain.
